These terms govern your use of TinyGallery. By using the site, you agree to them.
TinyGallery is a marketplace that connects buyers and sellers. We do not own, inspect, or take possession of items listed on the platform. Payments are processed by Stripe.
We are not a party to transactions between users and do not guarantee delivery, condition, or legality of any item. Shipping, delivery, and fulfillment are solely the seller's responsibility.
You are responsible for maintaining the security of your account and all activity that occurs under it. You must provide accurate information and keep it up to date.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use TinyGallery.
Sellers are responsible for listing accuracy, pricing, inventory, shipping, taxes, and customer service. You must have the rights to sell any work you list and comply with applicable laws.
Buyers are responsible for confirming listing details before purchase and complying with any stated policies from the seller.
Sellers are responsible for shipping ACEOs and must mark orders as shipped with a shipment date. Tracking is not required, but is encouraged for orders over $25.
If a seller ships without tracking and the envelope is lost, the seller is responsible for refunds. Sellers set their own shipping prices and can include tracking where they choose.
Buyers should confirm delivery or report issues within 14 days (domestic) or 25 days (international) after the order is marked as shipped. Orders auto-confirm on that date. Delivery confirmation occurs when a buyer marks an order delivered or when it auto-confirms after 14 (domestic) / 25 (international) days from shipment.
You may not use TinyGallery to engage in fraud, illegal activity, harassment, infringement, or any behavior that violates our Community Guidelines or Seller Guidelines.
Payments are processed by Stripe. Platform fees and Stripe processing fees apply as listed on the site. You are responsible for any taxes or government fees related to your sales, and we do not calculate, collect, or remit taxes on your behalf unless required by law.
TinyGallery Credits are a payment method that lets you load funds once and use them for multiple purchases without entering card info each time.
Refunds on unused credits
You can request a refund on completely unused credits within 14 days of loading them by contacting tinygallery.io@gmail.com. We'll refund your unused balance to your original payment method. TinyGallery covers Stripe processing fees on credit loads, but those fees are non-refundable and deducted from refunds.
No expiration: Credits never expire and stay in your account until you use them.
How processing works: Credit transactions are processed through Stripe. When you load credits, you pay via card (or another payment method) once, and TinyGallery covers the Stripe processing fee for that transaction. Future purchases using credits don't incur additional per-order card fees, so your total is just the listing price each time you use credits.
What credits are not: Credits are platform-only, non-transferable, not redeemable for cash, and do not earn interest. TinyGallery is not a bank and your credit balance is not a bank account--it's a prepaid balance for purchasing ACEOs on this platform.
No withdrawals or transfers: We do not offer buyer withdrawals, escrow services, or the ability to transfer credits to other users. Credits can only be used to purchase items on TinyGallery or refunded within the 14-day window if completely unused.
Sellers are paid via Stripe Connect directly to their bank account. We may aggregate funds and initiate seller payouts on a periodic schedule (typically bi-weekly). Payouts are usually released after delivery is confirmed or auto-confirmed—14 days after the seller marks an order shipped for domestic deliveries and 25 days for international. We may hold payouts longer if we suspect fraud, detect risk signals, or need time to review a dispute.
We use commercially reasonable efforts to maintain accurate credit balances and initiate payouts on time, but we may delay or reverse credits or payouts to comply with law, prevent fraud, resolve disputes, or manage risk. If a dispute or chargeback is opened, we may place a hold on the related payout or reverse it while we review. If a cardholder chargeback is filed, TinyGallery may deduct the chargeback amount plus fees from current or future seller payouts or seek recovery from the seller's linked bank account consistent with Stripe terms.
TinyGallery facilitates refunds by holding or reversing seller payouts when disputes are opened. Final refund decisions are made at our discretion after reviewing evidence from both buyer and seller.
Dispute window: Buyers may open a dispute within 30 days of purchase for (a) non-delivery after the seller marked the order as shipped, (b) item significantly not as described, or (c) item damaged in transit when shipped without tracking.
Evidence requirements: Buyers must provide photos, a description of the issue, and prior communication with the seller. Sellers must provide proof of shipment (tracking or postal receipt), listing screenshots, and a response to the buyer.
Our process: (1) Buyer opens dispute → related seller payout is held. (2) Both parties have 7 days to submit evidence. (3) TinyGallery reviews and decides within 14 days after the evidence window closes. (4) If a refund is approved, it is paid from the held seller payout; if denied, the payout is released to the seller.
Untracked shipping risk: Sellers who ship without tracking accept full liability for lost packages. If a buyer reports non-delivery and the seller cannot provide proof of shipment, TinyGallery will issue a refund from the seller's held payout.
Liability cap for disputes: For any dispute we review, TinyGallery will not be liable beyond refunding up to the transaction amount at issue. We are not responsible for indirect, consequential, or other damages arising from the dispute process.
You retain ownership of your content. You grant TinyGallery a non-exclusive, royalty-free, worldwide license to host, display, reproduce, and promote your content solely in connection with operating and marketing the platform. You must not post content that infringes on others' rights.
TinyGallery respects intellectual property rights. If you believe content on the platform infringes your copyright, you may submit a DMCA takedown notice to our designated agent at tinygallery.io@gmail.com.
We will respond to valid notices and may remove or disable access to allegedly infringing content. Repeat infringers may have their accounts terminated.
We may suspend or terminate accounts and remove listings at any time for violations of our policies or for behavior that risks harm to users or the platform.
Sections relating to disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.
TinyGallery is provided "as is" without warranties of any kind. We do not guarantee the availability, accuracy, or reliability of listings or services.
Some jurisdictions, including California, do not allow the exclusion of certain warranties. To the extent such exclusions are not permitted, they do not apply to you.
To the fullest extent permitted by law, TinyGallery will not be liable for indirect, incidental, or consequential damages, or for losses arising from transactions between users.
To the fullest extent permitted by law, TinyGallery's total liability for any claim is limited to the greater of $100 or the fees paid to TinyGallery by you in the 12 months before the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless TinyGallery and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration on an individual basis, except where prohibited by law. You waive the right to participate in class actions or class-wide arbitration.
You may opt out of arbitration within 30 days of accepting these Terms by contacting us at tinygallery.io@gmail.com.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Any legal action permitted under these Terms, including actions to enforce or challenge an arbitration award, shall be brought exclusively in the state or federal courts located in San Francisco County, California.
Some jurisdictions do not allow certain limitations or disclaimers. To the extent required by local law, certain provisions of these Terms may not apply to you.
Nothing in these Terms creates a partnership, agency, or employment relationship between TinyGallery and any user.
We may update these terms from time to time. We will post the updated Terms on the site, and continued use of the platform after changes take effect constitutes acceptance.
